This article aims to reflect from an interdisciplinary perspective on the assumptions or requirements of admissibility of judicial appeal, as well as on the important principles relating to it, in Civil Procedural Law, especially regarding dialecticity in the context of apelação. To this, based on the thoughts of the German philosopher Jürgen Habermas, especially with regard to Communicative Acting, in dialogue with the Law authors: Alexandre Freitas Câmara and Humberto Theodoro Júnior, we will seek to discuss the limits and potential of dialecticity as a communicative source in Civil Procedural Law and the possible obstacles relating to strategic rationality
