The article presents an overview of the creative industries and access to cultural goods in Brazil. The copyright laws are relevant but insufficient for the development of this industry. To the majority of the population, the lack of access to cultural property is not related to the framework legislation. The first part of the article presents the creative industry and its socioeconomic importance, as defined in the United Nations Conference on Trade and Development (UNCTAD) and World Intellectual Property Organization (WIPO) methodologies. The second part presents the results of the Cultural Supplement of Basic Municipal Information Survey (MUNIC-IBGE) in 2006, showing the precarious conditions of access to culture goods in most parts of the country. The overall conclusion of these analyses is that, despite shortcomings and flaws, is not the copyright laws that prevents access to cultural goods. Personal characteristics, like formal education, and materials conditions, such as cultural public policies and infrastructure development, facilitate access to cultural goods.
