Rediscovering the collectivity in the intellectual property scope

The concept of commons originated in the material domain, but in recent decades, it has been extended to intellectual property, opposing to historically constructed restrictions and promoting models of open access and collaboration. In this perspective, the present work constructed, through bibliographical research, a historical synthesis of the commons, and performed a comparison between the processes that occurred in the domains of material goods and intellectual property. It is observed that, in antiquity, the former had a more collective than private aspect, but underwent a process of closure, becoming mostly individual. Intangible assets, on the other hand, also presented themselves as collective, and underwent a similar process of closure, based on the recognition of their form of ownership and the creation of laws for their protection. However, unlike material goods, there was a turnabout: the recovering and re-adaptation of shared property and collaborative creation, promoting a movement for reopening the immaterial commons.
