REDESCOBRINDO A COLETIVIDADE NO ÂMBITO DA PROPRIEDADE INTELECTUAL

O conceito de commons se originou no campo material, mas, nas últimas décadas, foi ampliado para o campo da propriedade intelectual, como oposição a restrições historicamente construídas, promovendo modelos de acesso aberto e colaborativos. Nesse sentido, o presente trabalho realizou, por meio de pesquisa bibliográfica, uma síntese histórica dos commons e a construção de um paralelo entre os processos ocorridos no âmbito da propriedade sobre bens materiais e da propriedade intelectual. É observado que, na antiguidade, esta primeira possuía um aspecto mais coletivo do que privado, mas passou por um processo de fechamento, tornando-se majoritariamente individual. Já os bens imateriais, também se apresentavam como coletivos e passaram por um processo similar de fechamento, a partir do reconhecimento da sua forma de propriedade e criação de leis para sua proteção. Entretanto, diferentemente dos bens materiais, houve uma reviravolta: o resgate e readaptação das antigas ideias de propriedade compartilhada e criação colaborativa, promovendo um movimento de reabertura dos commons imateriais.
