Analysis of patent applications for inventions implemented by Artificial Intelligence in Brazil

Information Systems with Artificial Intelligence have been promoting a series of disruptive innovations worldwide and are regarded as a priority area by the Brazilian government. Intellectual Property, established through international agreements and laws, is the primary mechanism used in modern society to guarantee inventors the right to obtain a reward for their creation. In this sense, this research is based on the following problem: how is IP being used in Brazil? Specifically, it intends to: 1) verify if there are patents for inventions granted in Brazil; 2) examine the requests’ status and the interest over time; 3) identify the leading inventors and their origins; 4) the major application areas. The methodological procedures deal with the creation of a patent landscape of the patent requests for inventions having the term "artificial intelligence"in their title. The analysis considered patent requests to the Instituto Nacional da Propriedade Industrial that contains the term "inteligência artificial"(i.e., "artificial intelligence"in Portuguese) in its title. As a result the study analyzed 39 patent applications, identifying two patents granted to a Brazilian university and a growing interest in registering Artificial Intelligence-based inventions. The interest of USA companies in national protection is remarkable, despite the lengthy and arguable process. Increasing understanding of the patentability criteria of software-based inventions should promote a greater use for this type of Intellectual Property, improving the protection already guaranteed by the Software Law.
